Lawyer Lorenzo Gadon wants to stop the management of ABS-CBN Channel 2 from pleading before the Supreme Court for a Temporary Restraining Order (TRO) against the order from the National Telecommunications Commission (NTC) directing it to stop airing due to the absence of a franchise.

Gadon’s simple point— ABS-CBN did not follow procedures on pleading and headed straight to the highest tribunal of the land without filing a reconsideration first before the NTC and possibly, an appeal before the Court of Appeals. That’s it.

Under the rules on appeal, where there is an urgent constitutional issue that a party believes the Supreme Court (SC) must answer, such an appeal may be lodged before the highest tribunal. ABS-CBN lawyers must have raised this in theirs TRO.

TRO’s are usually exercised by local courts. Several landmark cases however, have recognized the validity of an issued TRO from the Supreme Court.

We simply don’t know why the ABS-CBN 2 is still entertaining such news items from this lawyer who was once suspended for crass behavior after using cursive language.
