Senator Chiz to File Disbarment against Atty Falcis

Senator Francis “Chiz” Escudero has formally filed a disbarment complaint against lawyer Jesus Nicardo Falcis III, accusing him of professional misconduct and violation of the Code of Professional Responsibility and Accountability (CPRA).

Escudero, a lawyer himself and former dean of the University of Santo Tomas Faculty of Civil Law, lodged the complaint before the Integrated Bar of the Philippines (IBP) and the Supreme Court’s Office of the Bar Confidant. According to his statement, the move stems from “malicious and irresponsible statements” allegedly made by Falcis against him in recent media interviews and social media posts.

The senator claimed that Falcis publicly accused him of “complicity in corruption” within the Senate without providing clear evidence, an act that Escudero described as “not only defamatory but unbecoming of an officer of the court.” Escudero argued that a lawyer has a duty to uphold truth and integrity, and that Falcis’s remarks undermined public trust in legal practitioners.

“In his capacity as a lawyer, Atty. Falcis must be held to the highest standards of ethics and decorum. Instead, he has resorted to baseless accusations that tarnish not only my name but also the credibility of the legal profession,” Escudero said in a prepared statement.

The disbarment case, if found to have merit, could strip Falcis of his license to practice law. Under the CPRA, lawyers may face sanctions ranging from suspension to disbarment for acts considered grossly immoral, dishonest, or prejudicial to the administration of justice.

Falcis, a known political commentator and advocate for human rights and LGBTQ+ causes, has yet to issue a formal response. However, in earlier remarks, he stood by his criticisms of Escudero, insisting that his statements were made in good faith and in the exercise of his constitutional right to free speech.

The IBP is expected to review Escudero’s complaint and forward its findings to the Supreme Court, which has the sole authority to disbar members of the bar. Legal experts note that disbarment cases are often lengthy and require strong evidence to prosper.

Political observers view the complaint as a potential flashpoint in the increasingly tense relationship between lawmakers and vocal critics from the legal and civil society sectors. As the case unfolds, it may test the balance between free expression and the ethical responsibilities of legal professionals in the country.
