OSG to study appeal on dismissal of quo warranto petition vs. ABS-CBN

The Office of the Solicitor General (OSG) said they will study the possibility of filing a motion for reconsideration of the Supreme Court’s (SC) dismissal of their quo warranto petition against ABS-CBN.

The OSG said it will consider filing the MR  “if necessary, given the constitutional issue on foreign ownership” it had raised in the petition once it receives a copy of the recent SC decision.

Earlier this week, the SC dismissed the OSG petition  that sought the forfeiture of ABS-CBN’s then-existing franchise over alleged “highly abusive practices,” including the company’s operation of a pay-per-view channel allegedly without a permit from the National Telecommunications Commission (NTC).

The franchise expired last May, prompting the SC to dismiss the case for being moot.

The petition against ABS-CBN Convergence remains.

Its franchise expired in March.

The quo warranto case is separate from the petition ABS-CBN filed to question the cease and desist order (CDO) from the NTC that forced it to shut down the broadcast operations of several of its radio and televisions stations the day after its franchise expired.

ABS-CBN’s petition is still pending.

It also asks for a temporary restraining order against the NTC’s directive,

“In the absence of a temporary restraining order from the Supreme Court, the CDO of the NTC remains valid and ABS-CBN’s television and radio broadcasting stations nationwide must remain off air,” the OSG said./Stacy Ang
